The Ohio Municipal Advisory Council (OMAC) is in receipt of a letter from the
Securities and Exchange Commission's Division of Market Regulation recommending
that the Division not take enforcement action against a Participating
Underwriter, pursuant to Rule 15c2-12 (the Rule), if the Participating
Underwriter reasonably determines that an issuer of municipal securities or an
obligated person located in Ohio has undertaken to provide the disclosure
information required under the Rule to the OMAC.
Information filed with OMAC
pursuant to the Rule is available on a nondiscriminatory, contemporaneous basis
to any individual or firm regardless of their membership status in the OMAC,
upon payment of an applicable fee (if not filed electronically). Available

Ohio's State Information Depository
In November 1994, the Securities and Exchange Commission (SEC) adopted
amendments to the Rule that prohibits a broker, dealer, or municipal securities
dealer (Participating Underwriter) from purchasing or selling, or recommending
the purchase or sale of, a municipal security unless they have reasonably
determined that an issuer of municipal securities or an obligated person has
undertaken to provide certain annual financial information and notices of
material events be filed with various information depositories, including a
State Information Depository (SID), if one has been established in that state.
Ohio Revised Code Section 113.31 authorizes the Treasurer of the State of Ohio
to designate a private entity as Ohio's State Information Depository. Pursuant
to a "Request for Qualifications" process, the Treasurer of the State of Ohio
has so designated the Ohio Municipal Advisory Council.
